These Pre-Booking Terms & Conditions ("T&Cs") govern the booking of future franchise locations to be officially named and launched by Nomadic Tastebuds Private Limited ("THE CHAI WALAH ").
By paying the Prebooking amount, the customer ("Franchisee") agrees to these T&Cs.

Booking Amount & Purpose
• The Customer agrees to pay a booking amount of ₹999/- for prebooking a location as an expression of interest for purchasing the respective franchise model.
• The booking is provisional and does not constitute a confirmed sale, delivery guarantee, or price commitment by the Company.

Expected Launch & Availability of Location
• The franchise outlets are expected to be launched and operational within 6 months of the prebooking date.
• The Company reserves the right to modify the launch timeline due to production, regulatory, or market-related factors.
• The Company reserves the right to decide who represents the brand THE CHAI WALAH in ANY Location

Refundability & Cancellation
• "All Sales are Final"
• The Prebooking Amount shall not be refundable if the Customer cancels the booking under any circumstances.
• The Prebooking fee is a consideration for removing the requested spot from the market and guaranteeing its availability for you. Therefore, this fee is considered earned upon payment and is non-refundable."
• All fees, deposits, or payments made to pre-book a location are strictly non- refundable. By paying this fee, you acknowledge and agree that no refunds will be issued for cancellations regardless of the reason."


Pricing & Adjustments

• The final price, specifications, and features of the store will be determined at the time of launch.
• The Company reserves the right to modify the Stores design, features, and pricing at its sole discretion.
• Upon launch, the Prebooking Amount will be adjusted against the final price of the store.
• THE CHAI WALAH reserves the right to revise or discontinue this Prebooking concept at its sole discretion.

Transferability & Non-Assignability
• The booking is personal to the Customer and cannot be transferred or assigned to another person without prior written consent from the Company.

Liability & Disclaimer
• The Company shall not be liable for any delays, modifications, or discontinuation of the contract of Any Store’s launch.
• The Customer acknowledges that this booking does not create any legal right to claim launching the store until a final sale agreement is executed.

Governing Law & Dispute Resolution
• These T&Cs shall be governed by the laws of India, and any disputes arising from these T&Cs shall be subject to the exclusive jurisdiction of the courts at Bengaluru

Additional Terms and Policies
• The Prebooking shall further be subject to the Booking Agreement, privacy policies and such other policies as are available at https://thechaiwalah.in/. In case of any conflict between the Booking Agreement and these T&Cs, these T&Cs shall be final.
• By proceeding with the payment, the Customer confirms that they have read, understood, and agreed to these Pre-Launch Booking Terms & Conditions.

KEY TERMS & CONDITIONS FOR NO COST EMI BY LENDER
• No Cost EMI (Equated Monthly Instalments) allows aspiring entrepreneurs to purchase the franchise by splitting the total cost into equal monthly instalments without added interest in shorter tenures of 36 to 60 months.
• Processing Fees & Taxes: While interest is waived, the Lender may charge a one-time processing fee, and GST is applicable on the interest amount.
• Penalty on Defaults: If an EMI payment is missed, high penalty interest rates can be applied by the Lender.
• No Early Foreclosure: Some agreements penalise or restrict early repayment of the loan.
• No Multiple Locations: One cannot get the benefits of No Cost EMI for more than one Location.
• Penalty Charges: Missing a payment deadline leads to late payment fees, interest penalties, and negative impacts on your credit score.
• Cancellation Policy after being Operational: If a franchise is cancelled for ANY reason or not being operational, the benefit of No Cost EMI offered will not be given in ANY form, and the user may be liable to pay current market rates of interest at the time, as noted in the Lender Terms & Conditions.
• Bank Discretion: The final approval for the No Cost EMI transaction rests solely with the issuing Lender, depending on various factors, including your creditworthiness, not the company.
